1. Introduction

Welcome to Wedding Snap ("we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of our QR code photo sharing platform (the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

2. Definitions

• "Account" means your user account registered with us.
• "User," "you," "your" means the individual or entity using or registering for the Service.
• "Content" means any photos, videos, messages, or other materials you or your guests upload to or share through the Service.
• "Event" means a wedding, celebration, or other gathering for which you create a photo sharing gallery.
• "Guests" means individuals who access your Event gallery via QR code to view or upload photos.
• "Subscription" means a paid plan that grants access to premium features of the Service.

3. Acceptance of Terms

By creating an Account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

4. Scope of Service

We provide a QR code-based photo sharing platform that allows you to create digital galleries for weddings and events, enabling guests to easily upload and view photos through QR codes. Features include photo galleries, QR code generation, guest uploads, photo downloads, and event management tools. We may modify, suspend, or discontinue any aspect of the Service at any time, with reasonable notice when possible.

5. Registration & Account Security

1. Eligibility: You must be at least 18 years old and legally capable of entering into contracts.
2. Account Information: You agree to provide accurate, current, and complete information when registering and to keep it up to date.
3. Security: You are responsible for safeguarding your password and for all activities under your Account. Notify us immediately of any unauthorized use.

6. User Obligations & Acceptable Use

You agree not to:

• Upload photos or content that violate copyright, privacy rights, or other intellectual property rights.
• Share inappropriate, offensive, illegal, or harmful content including but not limited to nudity, violence, harassment, or discriminatory material.
• Upload photos of individuals without their consent, particularly in private settings.
• Use the Service to spam, harass, or send unsolicited communications to other users or guests.
• Reverse engineer, decompile, or otherwise tamper with the Service.
• Interfere with or disrupt the integrity or performance of the Service or its infrastructure.
• Attempt to gain unauthorized access to our systems, other users' Accounts, or Event galleries you weren't invited to.
• Use automated tools or bots to upload content or access the Service.
• Use the Service for any illegal or unauthorized purpose.

7. Fees, Billing & Payment

• Subscription Plans: Access to premium features requires a paid Subscription. Current pricing and plans are available on our website.
• Billing Cycle: Subscriptions renew automatically on a monthly or annual basis, as selected.
• Payment Methods: We accept credit cards and other payment methods we may add from time to time.
• Late / Failed Payments: You remain responsible for all fees even if payment fails. We may suspend or terminate your Account for non-payment.

8. Content Ownership & Photo Rights

• Your Content: You retain full ownership of all photos, videos, and other content you upload to the Service.
• Guest Content: Photos and content uploaded by your guests belong to the respective guest who uploaded them, subject to any sharing permissions they grant.
• Service License: By uploading Content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, and process that Content solely to provide the Service to you and your guests.
• Sharing Permissions: When guests upload photos to your Event, they grant you permission to view, download, and share those photos as part of your Event gallery.
• Our Intellectual Property: All rights in the Service (including software, designs, logos, and trademarks) are owned by or licensed to Wedding Snap.

9. Feedback

We welcome feedback, ideas, bug reports, and recommendations (“Feedback”). You agree that any Feedback is non-confidential and becomes our sole property without compensation to you.

10. Data Retention & Photo Storage

• Storage Duration: We will store your photos and Event data for as long as your Account remains active and in good standing.
• Download Rights: You may download your photos and Event data at any time through your Account dashboard.
• Account Deletion: If you delete your Account, we will retain your data for 30 days to allow for recovery, after which it will be permanently deleted.
• Inactive Accounts: Accounts inactive for more than 2 years may be subject to data deletion with 30 days advance notice.

11. Termination

• By You: You may cancel your Subscription at any time via your Account settings. Your photos will remain accessible until Account deletion.
• By Us: We may suspend or terminate your Account and access to the Service at our discretion, for any reason, with reasonable notice when possible.
• Effect of Termination: Upon termination, your right to access the Service ceases and any unpaid fees become immediately due. You will have 30 days to download your content before deletion.

12. Disclaimers & User Responsibility

• No Warranty: The Service is provided “as is” and “as available” without warranty of any kind—express, implied, or statutory.
• Photo Quality & Storage: While we strive to maintain high-quality photo storage and display, we do not guarantee that photos will be preserved without any degradation or loss.
• Content Responsibility: You are solely responsible for the Content you and your guests upload. We do not monitor, review, or control user-generated content before it appears on the Service.
• Guest Behavior: You acknowledge that you are responsible for the actions of guests you invite to your Event gallery. We are not liable for inappropriate content uploaded by your guests.
• Backup Responsibility: While we implement backup systems, you are encouraged to download and maintain your own copies of important photos and content.
• Event Success: The Service is a tool to facilitate photo sharing. We do not guarantee that all guests will participate or that you will receive a specific number of photos.

13. Limitation of Liability

To the fullest extent permitted by law, Wedding Snap and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of (or inability to use) the Service, even if advised of the possibility of such damages.

14. Indemnification

You agree to indemnify and hold harmless Wedding Snap and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including attorneys’ fees) arising out of or related to:

• Your breach of these Terms;
• Your Content or use of the Service in violation of these Terms;
• Your violation of any law or the rights of any third party.

15. Privacy & Data Protection

Your privacy is important to us. Our Privacy Policy describes how we collect, use, store, and disclose your personal information. By using the Service, you consent to our data practices as described there.

16. Changes to Terms

We may modify these Terms at any time. When we do, we will post the updated Terms with a new “Last Updated” date. Continued use of the Service after changes indicates your acceptance of the new Terms.

17. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of [Your State], United States, without regard to conflict of law principles. Any dispute arising under or relating to these Terms shall be resolved exclusively in the federal or state courts located in [Your County], [Your State].

18. Miscellaneous
